Notarizing a power of attorney for use in India

If a bank, attorney, property professional, family member, or other receiving authority in India has already provided the POA, bring the complete document and signing instructions. We can perform an eligible North Carolina notarization but do not draft the legal instrument.

Prepare the POA before the notary visit

The notary cannot decide what powers to grant, draft property language, tell you which Indian registration procedure applies, or choose a legal form for you. Obtain the completed POA from the person or professional responsible for the transaction.

Notarization may be only one step

A document intended for use in India may have additional requirements after a U.S. notarization, such as witness formalities, an apostille, consular attestation, stamping, or registration. Those requirements can depend on the signer, citizenship or document type, the Indian state, and the receiving institution. Verify the next step before you sign.

Witnesses

If the POA or receiving authority requires witnesses, bring the exact instructions. A witness may be available at the store for $5 per witness signature when an eligible witness is available, but call ahead so availability can be confirmed.

Shipping after the document is ready

If the completed document needs to be sent to India, international shipping is available at the same physical location through The UPS Store. Shipping requirements and destination instructions are separate from the notarial act.

Do not sign blindly

Follow the instructions provided with your POA. If you are unsure whether a signature must be made in front of the notary or whether witnesses must sign at the same time, ask the attorney, bank, registrar, or other receiving party before your visit.
