When CMS uses a residency affidavit
CMS describes its residency affidavit as an option for certain families living with another household. The form also addresses tenancy without a written lease. CMS requires supporting residency documents and says the affidavit must be renewed annually. Confirm your situation with the school or Student Placement Office before choosing this form.

Arrange the visit with the person signing
The linked CMS form instructs the owner or lessee of the property where the applicant lives to complete and sign the affidavit. That person must personally appear for their notarization. A parent cannot simply bring an absent landlord’s signature and ask the notary to stamp it.
Ask the owner or leaseholder to read the complete affidavit before the visit. If there is uncertainty about who should complete it, contact CMS. The notary reviews identification and the requested notarial act; the notary does not decide a family’s residency eligibility.

What to bring to the notary
- The complete current CMS affidavit, including its notary section
- The owner or lessee whose signature needs notarization
- Qualifying current government-issued photo identification for that signer
- Any instructions provided by the school or Student Placement Office
Complete the document’s factual information beforehand if you can do so confidently. Leave the notary section for the notary and follow the notary’s instructions about signing. For an ID concern, review our North Carolina identification guide and call before traveling.
Prepare the separate CMS supporting documents
The affidavit instructions call for a copy of the owner’s or lessee’s mortgage statement, deed, or lease. They also direct the applicant to attach the most recent rent-payment record unless the affidavit states that no rent is paid. These materials support the school submission; they do not replace the signer’s identification.
Use CMS’s current requirements for the rest of the enrollment packet. If you cannot obtain the standard documents, ask CMS about the appropriate residency process. A notarized affidavit by itself does not guarantee enrollment or placement.
